- Bars the Council from voting on a proposed Federal Reserve supervision determination for a nonbank financial company until it first finds, after consulting the company and its primary regulator, that another action or a company-submitted plan is impracticable or insufficient.
- The required finding concerns the threat that the company's financial distress, or its activities, size, concentration, interconnectedness, or mix, could pose to U.S. financial stability.
- Allows the company to address the concern through a written plan submitted promptly to the Council.
- Makes a conforming change to the Council's review provisions so they cross-reference the new requirement.
